TERMS AND CONDITIONS FOR CAR LEASING

(“TERMS AND CONDITIONS”)

1. INTRODUCTION

1.1

Damia Car Rental is a car rental business operating in Malaysia with its business address located at No 53-1, Jalan Wangsa Delima 5, Seksyen 5, Wangsa Maju, 53300 Kuala Lumpur (hereinafter referred to as “Damia Car Rental”).

Damia Car Rental operates via an integrated online platform, offering comprehensive car leasing services to both domestic and international customers. Our core business revolves around facilitating seamless transportation solutions for our customers, ensuring convenience, safety, and comfort throughout the rental period (“the Business”).

1.2

You (as “the User”) hereby agree to lease a vehicle from Damia Car Rental (“Lease Vehicle”), where the details and specifications of the Lease Vehicle are determined based on your selection via Damia Car Rental’s official website at https://www.klcarrental.com (“the Website”).

Damia Car Rental agrees to provide the Lease Vehicle to the User in accordance with these Terms and Conditions.

1.3

By accessing, browsing, or using the Website and Damia Car Rental services, the User acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.

1.4

The User acknowledges that Damia Car Rental reserves the right to amend, modify, or revise these Terms and Conditions at any time. Updated Terms and Conditions shall be published on the Website. Continued use of the Website or services constitutes acceptance of such amendments.

2. REQUIREMENTS

2.1

The Lease Vehicle shall only be driven by the User and/or additional registered driver(s) approved by Damia Car Rental (“Drivers”).

The User hereby undertakes that:

(a) Driver Age Eligibility

A – B	23 to 65 years
C – D	23 to 65 years
E	25 to 65 years
F (Luxury)	25 to 65 years

(b) Foreign Driving Licenses

ASEAN driving licenses are valid in Malaysia subject to Section 28 of the Road Transport Act 1987, provided the license remains valid in the issuing country.

If the license is not in English or Bahasa Malaysia, a certified translation is required. Damia Car Rental shall not be liable for issues arising from non-compliance.

Non-ASEAN foreign nationals must possess a valid International Driving Permit (IDP).

(c)

Drivers must not be probationary license holders.

(d)

Drivers must not suffer from any medical or physical condition that impairs driving ability.

(e)

Drivers must have a clean driving record for at least five (5) years.

(f)

Drivers aged 65 and above may be required to submit medical certification or proof of active driving history.

3. LEASE PERIOD

3.1

The Lease Term shall be as stated in the booking confirmation.

3.2

The User must return the Lease Vehicle on time to the agreed Return Location.

4. MODIFICATION OF BOOKING

Any request for:

• Extension of lease

• Additional driver registration

• Change of pick-up/return date or location

Must be approved in writing by Damia Car Rental before lease expiry.

5. CHARGES

5.1 Lease Charges

• Minimum rental: 24 hours

• Additional hours: 1/5 daily rate per hour (max 5 hours)

Includes:

• Unlimited mileage

• Maintenance

• Third-party insurance coverage

No refund for early return.

5.2 Deposit

• Refundable within 15 days after vehicle return

• Subject to inspection and deductions if applicable

5.3 Penalty Charges

6. PAYMENT TERMS

A valid payment method is required. Damia Car Rental reserves the right to cancel bookings if payment terms are not fulfilled.

7. CANCELLATION & REFUND POLICY

Refund Eligibility

• Full Refund: Cancel >72 hours before pickup

• Partial Refund: Cancel within 72 hours (50% one-day rental + 5% processing fee)

• No Refund:

  • No show

  • Cancel within 24 hours

  • Downgrade last minute

  • Failure to present registered driver

Deposits refunded after 15 days from vehicle return.

8. USER RESPONSIBILITIES

The Lease Vehicle must NOT be used for:

• Illegal purposes

• Commercial use or subleasing

• Racing, towing, off-road use

• Carrying pets, durian, salted fish

• Smoking inside the vehicle

User is responsible for:

• Traffic summons

• Parking fees

• Lost keys or accessories

• Fuel refill (full-to-full policy)

9. LIABILITY REDUCTION OPTION (LRO)

LRO must be purchased before lease starts.

Insurance does not cover negligence, tire damage, wrong fuel, or accessories loss.

10. RESTRICTED USE

• Vehicle cannot be driven to Thailand, Brunei, Indonesia

• Not allowed on ferries or islands (Langkawi, Tioman, etc.)

• Singapore entry only via Damia-approved arrangement

11. LEASE-IT-HERE, LEAVE-IT-THERE

Available with:

• Minimum 2-day rental

• One-way repositioning fee applies

12. CLAIMS & LETTER OF DEMAND

Failure to respond to accident or damage claims may result in:

• Deposit deduction

• Issuance of Letter of Demand

• Legal action

13. TERMINATION

Damia Car Rental may terminate the agreement for:

• Non-payment

• Breach of terms

• Insolvency or legal distress

---

14. GOVERNING LAW

This Agreement is governed by the laws of Malaysia.

15. PROCESSING & ADMIN FEES

• Minimum: RM5

• Maximum: 10% of total claim

• Includes traffic fines, damages, missing fuel handling
